Charles' only recorded appearance in Pittsylvania Co. VA is witnessing a deed with George Lay for David Lay, Sr. in 1788 Charles appears in the 1782 Surry Co., NC Tax List alongside his in-laws, Samuel and William Freeman, with 1 cow, 1 horse and no land. Charles purchases land in Surry Co., NC in 1785, and is a juror in 1786 and

1789. Charles also enters land (1000 acres) on Connerros Cr., Pendleton District, SC in 1787. Charles is recorded tw ice in the 1790 Federal Census In 1790 Surry Co. NC, Charles is enumerated with 1 male >16, 3 males <16, and 2 females. In 1790 Pendleton District, SC, Charles is enumerated with 1 male >16, 3 males <16, and 3 females. It might seem that there are two Charles Lay's in 1790 until one realizes that it took two years to enumerate SC for the 1790 Federal Census. Several upcountry, SC district, 1790 returns, are dated 1791. Apparently a daughter was born between the census count in Surry Co., SC in 1790 and the census count in Pendleton District, SC in 1791.

In J. Gilbert Lay' s book, Lay Family Genealogy, he tells of a family tradition that Charles’ mother's name is Nancy Middleton. If this were true then Nancy Middleton would be the wife of David Lay, Sr. A John Mliddleton appears in the 1767 Pittsylvania Co., VA Tax List. Charles' daughter Sarah married Nathaniel Lynch. born in Pittsylvania Co., VA. Charles died c 1829 in Pickens Co , SC. His will mentions sons Davyid, John., James. Charles F., and William.

This Charles has been erroneously named as the possible father, of a William Lay, who married a Taliaferro. This is probably due to (1) his presence as a neighbor to John Taliaferro in the Surry Co , NC 1782 Tax List, (2) Charles' presence on a Taliaferro document in Surry Co. NC, and (3) the presence of both Charles's son William and the William Lay (formerly of Roane Co.. TN) in 1840 Cherokee Co.. AL.
