591John makes his first appearance on the 1776 Pittsylvania Co VA Tax List. John is consisently enumerated on subsequent tax lists through 1795. The 1782 VA State Census enumerates John with six in his household. John is enumerated in the 1787 VA State Census with eight in his household. John is enumerated with 2 polls >16 in the 1794 and 1795 Pittsylvania Co VA Tax Lists. A William Lay appears with John on the Pittsylvania Co Tax List 1791-95 with one poll >16. Statistically, this William appears on the tax list too soon to be a son of John but the fact that David Sr. and David Jr. have departed Pittsylvania Co indicates that this theory can’t be dismissed. John Lay witnessed a deed (DB 3:511) in Pittsylvania Co on 22 Nov 1773.
1064 While a person did not have to be 21 to witness a land transaction, John may be older than a ca 1755 birth year.
This John Lay died in 1796 in Pittsylvania Co VA. John Wilson was appointed administrator of his state on 21 Nov 1796.
1065 An inventory appraisal of John's estate was recorded 9 Dec 1796.
1066 The appearance of John in Pittsylvania Co 1789-1795 rules out that he is the John Lay enumerated in the 1790 Guilford Co., NC Federal Census. John's death in 1796, rules out that he migrated westward and is the John Lay of any tax list in Last TN 1796-1818. Furthermore, this John Lay is a separate individual from John Lay of Caswell Co., NC.
The fact that John's household increased by two between 1782 and 1785 indicates he had minor children at his death. Documentation regarding any appointed guardians has not been found. A Cain Lay married Polly Flack in nearby Rockingham Co., NC, 15 Oct. 1800. Interesting is that a Cain Lay appears in the 1810 Chester District., SC Federal Census living next door to a John Lay in the same vicinity of an older James Lay. This James Lay has been previously mentioned in this article as a possible candidate for the son of 1757 deceased Halifax Co , VA John. Cain and Polly Flack Lay later appear in the records of Madison Co KY. John and Cain Lay may be sons of this John, along with a Byrum Lay, who first appears in the 1816 Pittsylvania Co, VA Tax List, and whose presence continues through to the 1830 Pittsylvania Co., Federal Census.
