Will Book No. 1, p 427

In the Name of God Amen I Henry Hayley of Greenville County being at present very sick and weak of Body but of sound and disposing mind and memory thanks be to God therefore to make and ordain this my last Will and Testament in the following manner to wit

--- Imprimis I lend unto my beloved wife Rodicey Hayley one third of my Plantation whereon I now live and Lands adjoining the same lying on the North side of Fountain Creek during her natural Life and at her death I give the said land and Plantation unto my son Henry Hayley to him and his heirs for ever.

---- Item I give and bequeath unto my Son Henry Hayley the remaining two thirds of my Plantation wheron I now live and all my Land adjoining the same lying on the North side of Fountain Creek to him and his heirs for ever.

----- Item I give unto my Son Richard Hyde Hayley the plantation whereon he now lives and all my Lands adjoining the same lying on the South side of Fountain Creek to him and his heirs for ever.

----- Item I lend unto my beloved Wife Rodicey Hayley one half of all my Negroes during her natural life and at her death I give the said Negroes & their increase to my Son Henry Hayley to him and his heirs for ever.

----- Item I give and bequeath unto my son Henry Hayley the remaining half of my Negroes and their increase to him and his heirs forever.

-----Item I give unto my Son Henry Hayley the remaining two thirds of My flock of Mech in trade to him and his heirs for ever.

-----Item I give unto my Son Richard Hyde Hayley the Stock of all kinds whatever that he hath in possession also all the Household furniture that he has in possession to him and his heirs forever

---- Item I give unto my Daugher Lettisha Frances the Stock and Household furniture of all kinds whatever that she hath in possession to her and her heirs forever

---- I give unto my daugher Janet Jordan the Stock and Household furniture of all kinds whatever that she hath in possession to her and her heirs forever

----- Item I give unto my beloved wife Rodicey Hayley one third of all my Estate of all kinds whatever not heretofore given to her and her heirs for ever.

---- Item I give unto my Son Henry Hayley the remaining two thirds of all my Estate of all kinds whatever not heretofore given, to him and his heirs forever. My desire is that my Estate shall not be Inventoried nor appraised also that my Executors hereafter mentioned may not be held to security. My desire further is that my Son Henry Hayley shall be brought up with discreton of my Executor hereafter mentioned also all my Estate devised to my Son Henry Hayley may be in the hands of my said Executor unto my Son is capable of taking charge of the same himself also that my Executor act at his own discretion for the benefit of my Estate and Son aforesaid. I nominate and appoint my friend Henry Smith my whole and only Exct of this my last Will and Testament hereby revolking all other wills heretofore by me made in Witness whereof I have hereunto set my Hand and Office my Seal this Seventh Day of June Eighteen Hundred and one. -----

Greenville July Court 1801 This Will was proved according to Law by Thomas Dupree, John Jordan, and Richard Harrison witnesses thereto and ordered to be recorded. And on the motion of Henry Smith, the Executor therein named who made Oath thereto, and entered into Bond in the penalty of Twenty Thousand Dollaars conditioned as the Law thereof certificate was granted him for obtaining probate thereof in due form
