Notes for Daniel Bryan Lay Sr.
Daniel Lay married Elizabeth Duck in 1848. The family was listed in the 1850 census of Pulaski Co but apparently moved to Texas after the birth of Maranda Elen, who was born in Pulaski Co KY in 1852, but before the birth of Francis Marion Lay, who was born in Wilson Co TX in 1855.

The family first lived in San Antonio, but soon settled in La Vernia (Brief history of La Vernia278).

"D. B. Lay represents that his wife Elizabeth Lay departed this life in San Antonio Bexar Co TX on 21 March 1884 leaving surviving besides the applicant the following named children: Mrs. Elen Hawkins (formerly Lay), now a widow aged 35 years who resides in Bexar Co TX; Virginia, now the wife of G. B. Smith, aged 28 years who resides in San Antonio, TX; Mary Bell, aged 26 years, now the wife of Sim Wills residing at Ladonia in Fannin Co, TX; Alice, aged 23 years, now the wife of L. B. Mitchell, who resides at Seguin, Guadalupe Co, TX; Marion Lay, aged 30 years residing in Wilson Co, TX; Daniel Lay, a minor aged 20 years, residing in Bexar Co, TX; and Emma Lay, a minor residing in Bexar Co, TX, aged 17 years. Applicant requests the appointment of appraisers to appraise the estate."
The Court appoints F. G. Sprauge, P. C. Smiley, and Gilbert Pettis.
Inventory and Appraisement: 300 acres of land part of the J. W. San Miguel Survey in Wilson Co, TX, value at $15.00 per acre, $4500.00; about 45 head of cattle, at $7.00 per head, $315.00; household & kitchen furniture, $29.75; Total $4,844.75. D. B. Lay swears that there are no claims on the estate which are collectable.
Bond for $4,844.75 guaranteed for D. B. Lay by C. W. Wiseman and T. A. Tiner.

30 August 1887: Estate of D. B. Lay & Deceased Wife. Petition to be Discharged from Bond.280
"LaVernia, Texas August 27, 1887
To the Hon. Judge Worsham
I wish to be relased (sic) from Mr. D. B. Lay & Bond for the reason that he did not comply with my request when I signed it. I wish that you would notivy him that he must get some one else in my place.
C. W. Wiseman"
The Court orders D. B. Lay to file with clerk a new bond within ten days.
9 September 1887: New Administrators Bond guaranteed by D. B. Lay as principal and Henry Yelvington, Gus Tiner, and J. S. Craighead as sureties.

8 October 1887: Estate of Elizabeth Lay, decd. Application for annual allowance.281
"Surviving husband D. B. Lay petitions the Court to make an allowance out of the estate sufficient for the support of the petitioner and his two minor children Daniel Lay and Emma Lay for one year. Court orders that an allowance of $400 be made out of said estate for said purpose."

9 December 1887: Estate. Community Property D. B. Lay & Decd. Wife. Petition to be Discharged from Bond.282
"To the Hon. W. L. Worsham, County Judge Wilson County, Texas.
The petition of J. S. Craighead would respectively represent that he is one of the sureties of D. B. Lay on his Bond as administrator of the Community property of his estate.
Petitioner prays that the said administrator be required to give a new bond and that the petitionor may be discharged from all liability for the future acts of said Administrator and as in duty bound petitionor will ever pray.
J. S. Craighead"
Court orders D. B. Lay to file a new bond with the court within ten days.
